These Terms of Service ("Terms") govern your use of the website and the services provided by T&S Property Management ("T&S Property Management," "we," "us," or "our"), located at 234 South Line Rd, Middle Grove, NY 12850. By requesting a quote, scheduling work, or using our services or website, you agree to these Terms.

1. Acceptance of Terms

By accessing our website or engaging us for services, you confirm that you are at least 18 years old and able to enter into a binding agreement. If you do not agree with these Terms, please do not use our website or services.

2. Services

T&S Property Management provides junk removal, demolition, jobsite cleanup, home cleanouts, power washing, and lawn maintenance services in Middle Grove and the surrounding Saratoga County, New York area. The specific scope of any job will be agreed upon between you and us before work begins. We reserve the right to decline or discontinue any job at our discretion.

3. Quotes & Estimates

Quotes and estimates are based on the information you provide and, where applicable, an on-site assessment. Pricing may change if the actual scope, volume, weight, access conditions, or materials differ from what was described. We will communicate any change in price before performing additional work whenever reasonably possible. Quotes are valid for the period stated, or 30 days if no period is stated.

4. Scheduling & Cancellations

We will work with you to schedule service at a mutually convenient time. Arrival windows are estimates and may be affected by weather, traffic, prior jobs, or other factors. If you need to reschedule or cancel, please contact us as far in advance as possible. We reserve the right to charge a fee for missed appointments or last-minute cancellations where significant time or resources were reserved.

5. Payment Terms

Payment is due upon completion of the work unless we agree otherwise in writing. We accept the payment methods communicated to you at the time of service. Past-due balances may be subject to reasonable late fees and collection costs permitted by law. You are responsible for any applicable taxes.

For safety and legal reasons, we generally do not handle hazardous or regulated materials, including but not limited to asbestos, chemicals, solvents, fuels, oils, paints, pesticides, medical or biohazardous waste, ammunition, or other materials prohibited from standard disposal. If such materials are discovered during a job, we may stop work and require that they be handled by a properly licensed provider. Any items we remove are deemed abandoned by you and may be disposed of, recycled, or donated at our discretion.

We take reasonable care while performing our services. You acknowledge that certain work—such as demolition, hauling, and power washing—carries inherent risks, and that normal wear, pre-existing conditions, or unavoidable contact may occur. We are not responsible for pre-existing damage, hidden conditions, or damage resulting from inaccurate information provided by you. Please notify us of any concern about damage within 7 days of the service so we can address it.

9. Disclaimer of Warranties

Our services and website are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. We do not warrant that the website will be uninterrupted or error-free.

To the fullest extent permitted by law, T&S Property Management and its owner and employees will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to our services or website. Our total liability for any claim relating to a job will not exceed the amount you paid us for that job.

You agree to indemnify and hold harmless T&S Property Management and its owner and employees from any claims, damages, or expenses arising out of your breach of these Terms, your misrepresentation regarding ownership or authorization, or the presence of undisclosed hazardous materials at the site.

By providing your phone number and email, you agree that we may contact you about your quote, scheduling, and services by phone, text message, and email. Message and data rates may apply. You can opt out of marketing texts at any time by replying STOP, and opt out of marketing emails using the unsubscribe link. See our Privacy Policy for details on how we handle your information.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or our services will be brought exclusively in the state or federal courts located in Saratoga County, New York, and you consent to the jurisdiction of those courts. The parties will first attempt to resolve any dispute in good faith through direct communication.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our website or services after an update means you accept the revised Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
